KAOHSIUNG — A Kaohsiung man surnamed Li (李) and his associate Hsieh (謝) were sentenced by the Kaohsiung High Court (高雄高等法院) for drugging and sexually assaulting a male acquaintance in a case that drew widespread attention. (Yahoo News)

According to indictments and reporting, Li developed an unreciprocated romantic interest in a male friend referred to in court records as “A.” In November 2023, Li and Hsieh lured A to a karaoke venue in Kaohsiung under the pretext of singing and socializing. (Yahoo News)

Prosecutors said that as A went to the restroom, Li slipped a sedative commonly called “G-water” (GHB, gamma-hydroxybutyrate) into his drink, causing A to lose consciousness. Afterward, Li and Hsieh transported A to a motel, where Li bound and sexually assaulted him while recording the encounter on video. (Yahoo News)

In the initial trial, the Kaohsiung District Court found Li guilty and sentenced him to 8 years and 4 months in prison. Hsieh, who provided the sedative and participated in the plot, was sentenced to 7 years and 3 months. (匯流新聞網)

On appeal, the Kaohsiung High Court, after reviewing the facts and considering Li’s efforts at reconciliation, reduced Li’s sentence to 7 years and 6 months, while affirming Hsieh’s 7 years and 3 months term. (匯流新聞網)

    Legal Context

Drug-facilitated sexual assault — including using substances to incapacitate a victim and engaging in sexual activity without consent — is prosecuted under Taiwan’s laws protecting sexual autonomy. Convictions carry significant prison terms.

Local media coverage highlighted not just the specifics of the case but also broader concerns about the misuse of substances like GHB or “G-water“ to incapacitate victims and the recording of assaults, which can compound victims’ trauma. (Yahoo News)

There have also been other reported incidents in recent years involving drug-assisted sexual assaults in Kaohsiung, underscoring ongoing law enforcement and community concerns about preventive measures and awareness. (news.ebc.net.tw)

With the High Court judgment in place, both defendants have the right to seek further appeal to the Supreme Court. If upheld, Li and Hsieh will serve the respective sentences imposed for their roles in the assault.
