    Inmate Sentenced to 3 Years for Sexual Assault in Kaohsiung Prison

    Court also orders NT$350,000 in damages to victim

    KAOHSIUNG — A male inmate surnamed Tsai (蔡) has been sentenced to three years and four months in prison after sexually assaulting a fellow inmate while the victim was asleep, according to a ruling by the Ciaotou District Court (橋頭地方法院).

    The case stems from an incident on March 10, 2024, when Tsai, whose bedding had not yet dried after it had been washed, temporarily shared a bed with another inmate, identified as “A”. The Liberty Times reports prosecutors told the court that Tsai was aware that “A” routinely took sleeping medication before bed. In the early hours of the morning, while “A” was asleep, Tsai took advantage of the victim’s drug-induced deep sleep to fondle him and commit other sexual acts.

    There is no publicly available data on the prevalence of sexual assault within Taiwan’s prison system, though isolated cases do surface in court rulings. Taiwan does publish national sexual assault data, but not broken down by prisons. A 2025 paper by the Taiwanese Journal of Psychiatry said annual reported cases are in the ~7,700–9,400 range nationwide. If accurate, these figures mean Taiwan’s rate of such offenses is roughly comparable to that of many other developed countries.

    During trial proceedings, Tsai admitted to the offense. However, the court noted that he initially denied wrongdoing, claiming the victim had been aware of the acts. Judges found his post-offense attitude unsatisfactory, citing a failure to fully acknowledge responsibility and his absence from mediation proceedings after stating he could not afford a settlement.

    The court convicted Tsai under charges related to sexual assault of an incapacitated person and imposed a sentence of three years and four months. The ruling remains subject to appeal.

    In a separate civil case, the victim sought NT$400,000 in damages for emotional distress. The court ultimately awarded NT$350,000, taking into account both parties’ circumstances and the severity of the offense.
