KAOHSIUNG — A Kaohsiung husband has been awarded NT$200,000 in civil damages after a court found that his wife and another man crossed the accepted boundary of marital conduct by staying overnight in the same hotel room.
The man, surnamed Wen (溫), sued his wife and a man surnamed Huang (黃), seeking NT$500,000 in compensation, the Liberty Times reports.
Wen said his wife traveled with Huang to Taichung from Dec. 18 to Dec. 20 last year and stayed in the same hotel room with him on Dec. 19 while her marriage was still in effect.
According to the ruling, Wen’s wife later wrote a confession stating that she and Huang had feelings for each other. Huang also called Wen to apologize.
The defendants denied wrongdoing in court.
Wen’s wife said she only wrote the confession to preserve family life and that its contents were not true. Huang said his apology was made only to ease tensions.
They also argued that the two were not alone in the room because Wen’s two minor children were present, and said they did not share a bed because Huang was feeling unwell.
However, the Ciaotou Summary Court said a violation of spousal rights does not depend only on whether sex or physical intimacy occurred.
The judge said that, under ordinary social standards, staying overnight in the same room with someone who is married exceeds a reasonable boundary.
The court ordered the two defendants to jointly pay Wen NT$200,000.
The ruling can be appealed.
